Toplace Pty Ltd Voluntary Administration

NSW Fair Trading < 1 mins read

11 July 2023

Antony Resnick and Suelen McCallum of DVT Group were appointed voluntary administrators (Administrators) of Toplace Pty Ltd (Toplace) on 7 July 2023. For the duration of the administration, the Administrators have exclusive authority to deal with the property, assets and liabilities of Toplace.

NSW Fair Trading understands this event will create uncertainty for many strata communities and businesses.

This afternoon NSW Fair Trading published information to advise strata communities and businesses on how they can notify the Administrator that they are impacted by the voluntary administration.

NSW Fair Trading is also working with Strata Communities Australia (NSW) and the Owners Corporation Network to assist strata managers and owners within Toplace buildings.

Purchasers who have paid a deposit towards an off-the-plan sale are advised to contact their conveyancer or legal advisor and seek advice on their contractual entitlements.

The voluntary administration may affect other licenses and registrations held by Toplace or associated entities. NSW Fair Trading will publish updates on the public register available at licence.nsw.gov.au.

The disciplinary action to cancel and disqualify Toplace's contractor licence remains in force. Also building work rectification orders and other orders issued by NSW Fair Trading remain in force at this time.

Complaints can be lodged online with NSW Fair Trading and questions can be answered by calling Service NSW on 13 77 88.

The administrator can be contacted by calling (02) 9633 3333 or emailing [email protected].

More information on the voluntary administration process can be found by visiting the Australian Securities & Investments Commission website.
