A Declaration of over 5,000 academics, doctors, mental health practitioners, teachers and concerned citizens has called on all Australian political parties and candidates to clarify their answer to the question ‘What is a Woman’ prior to the election on May 3rd.
The call follows the recent case in the UK where the Supreme Court clarified that the term ‘woman’ is based on biological sex, not gender identity.
The Australian Sex Discrimination Act currently states it is unlawful to discriminate on the basis of age, disability, race, sex, intersex status, gender identity and sexual orientation. The term ‘gender identity’ was added in 2013 by the Gillard Government.
The Declaration calls for the removal of ‘gender identity’ from the act and to confirm the legal definition of a woman based on biological sex. As this definition impacts over 50% of the population, signatories to the Declaration believe it is vital Australians know clearly where each party and candidate stands.
Included in the list of public signatories to the Declaration are Emeritus Professor Colin Wight from the University of Sydney, Women's Rights Advocate Sall Grover and prominent Child and Adolescent Psychiatrist Dr Jillian Spencer.
According to Dr Spencer “As rightly found in the UK, the legal definition of a woman or a man is based on biological sex. When the perceived rights of a few transgender individuals erode the established rights of the majority and our ability to tell the truth, there is a problem. The law must return to how it was pre-2013.”
Founder of the Declaration, past UNSW Biology Educator Phil Dye, said that “Australians have seen women’s and girls’ sports, school biology education and adolescent health impacted by the ‘’gender identity‘ phrase added in 2013. It may have meant well, but its inclusion to please a micro-minority has eroded the rights of all biological women and girls in Australia. It’s time to follow the UK and adhere only to the biological definition.”
After the May 3 election, the Declaration of Biological Truth, will consult Government Ministers and Senators to prepare a parliamentary bill removing the gender identity phrase from section 5B of the Sex-Discrimination Act and its accompanying Guidelines. This will occur as early as July 2025.
