D & N Rubber Refinery has been fined $30,000 for the second time this year after allegedly stockpiling more than 90 tonnes of waste tyres, equivalent to the weight of around 60 average cars, at its Smithfield site without the required licence.
NSW Environment Protection Authority (EPA) officers inspected the site in July 2025 and, during a follow-up visit a few weeks later, found it was still storing more than 37 tonnes of waste tyres, well above the five-tonne limit allowed for unlicensed facilities.
EPA Executive Director Operations Steve Beaman said the company has been repeatedly warned and must take its obligations seriously.
“People have homes close to this site and planes fly overhead from Bankstown Airport, so the risks here are real and unacceptable, Mr Beaman said.
“Strict limits are in place for waste tyres to reduce pollution and fire risks, and D & N Rubber is fully aware of those rules.
“We are keeping a very close watch on this site given its repeated non-compliances. If the company continues to ignore the law, it can expect harsher regulatory action.
“Tyre stockpiles can fuel intense fires that burn for days, are very hard to put out, and produce thick, toxic smoke that impacts air quality for nearby communities.”
This latest fine follows a penalty issued in April 2025, when the company was found to have not complied with a Prevention Notice requiring tyre stockpiles to remain below licensing thresholds.
